Senate elects special commission that will examine the process of impeachment

The full Senate elected today (25) the 21 headlines and 21 alternate members of the special commission that will examine the impeachment of President Dilma Rousseff. The official installation of collegiality, with the election of President, Vice and the rapporteur, It is scheduled for tomorrow.

After installation of the special commission, starts counting the period of ten working days for the rapporteur to present his opinion on the admissibility of the opening of proceedings. In this phase there is no defense prediction of President. The opinion needs to be voted by members of the joint committee and approval is given by a simple majority.

Whatever the outcome of the vote in committee, the final decision is up to the Senate, that is sovereign. in plenary, the committee's opinion will be read and, after 48 hours, voted nominally by Senators. To be approved is required half plus one of the votes of the senators, since at least vote 41 of 81 senators.

The first step of the procedure of impeachment in the Senate was the plenary reading, no dia 19, the opinion of the House in favor of opening the process. Then, Senate President, Renan Calheiros (PMDB-AL), created a special commission to examine the case and asked the party leaders indicating the 42 Senators who will compose the committee: 21 headlines and 21 alternates. The document read in plenary was published on 20 in the Official Journal of the Senate.

If the committee's opinion is the admissibility of the impeachment process and the text is approved by the Senate, the case against the president is established and Dilma will be notified and removed from office by 180 days. Thereby, Vice President Michel Temer takes office. If the committee's opinion is rejected in plenary, the complaint against the president will be filed.

If the removal process is open, begins the evidentiary phase and the possible convening of the complainants, of President Dilma and defense until the completion of the investigation and the vote on the opinion of the special committee on the process.

For the president lose the mandate are needed the votes of at least 54 senators, two-thirds of the House. The final session of the trial will be led by the President of the Supreme Court, Ricardo Lewandowski.

In case of acquittal, the President returns to office immediately. It condemned, it is automatically stripped and is eight years without being able to exercise public office. Or vice, Michel Temer, assumes the presidency until the end of term, in December 2017.
