Fearing sanctions law that charges Netflix and Spotify taxes

Approved in early December by the Senate, an amendment on the Tax collection system of any nature Services (ISS) It was sanctioned on Friday, 30, by the President, Michel Temer. To her, among other changes, passes the charge streaming services tax, like Netflix and Spotify.

According to the publication made on Friday in the Official Gazette, They are subject to a fee “the availability, without final assignment, audio content, video, image and text via the Internet”. The law impacts other paid services, como o Apple Music, Google Play Música, Amazon Prime Video and many others, plus apps and paid games provided by download.

The ISS had its minimum rate fixed at 2%. It is not known whether the tax will be passed on to customers streaming services, but, as the collection of this tax is municipal, the percentage to be charged may be higher, depending on the city. This means there is the possibility that Spotify, Netflix and the like have a price in São Paulo and another in Salvador, for example.

Temer came to veto some parts of the law, because the determination of the domicile of the service taker in some cases. With respect to the streaming tax, nothing has been changed in the text approved by 63 Senate two weeks ago. The law begins to be worth in March 2017.
