Court denies injunction requested by Chico Black for annulment of the election CMMIn the claim the applicant submits that during the election process there was no compliance with the principle of proportionality party.
The judge Ari Moutinho Jorge da Costa denied the preliminary injunction Injunction required by councilman Chico Black and the Party of National Mobilization they intended to nullify the election of the table-director of the City of Manaus, held on January 1 and which resulted in the reelection of Councilman Wilker Barreto (PHS) the presidency of the municipal legislative.
The claim presented in the warrant, the applicant maintains that during the election process there was no compliance with the principle of proportionality party. In the decision handed down on Thursday (23), the judge denied the injunction and held that the annulment of the presiding board election would affect the rights of parties and elected councilors to form the direction of CMM. The rapporteur also noted that the petitioner did not promote quote of parties and councilors as required joint parties.
Initially, the injunction was distributed to the judgment of the 2nd Court of the Treasury Municipal determined that the referral to the Joint Chambers.
Wilker Barreto was returned to the presidency with CMM 38 votes in favor. The councilors Chico Black and Joan of Arc (PR) also they competed for the presidency. Chico had two votes and only one Joana.
