The Second Chamber of the Supreme Court (STF) denied today (28) defense appeal and keep the arrest of former Deputy Eduardo Cunha, arrested in Operation Lava jet since October last year.
Cunha was sentenced to 15 years in prison for passive corruption and money laundering, without right to appeal in freedom, by Federal Judge Sergio Moro. currently, he's stuck in the Penal Complex-Medical (CMP), the metropolitan region of Curitiba.
The vote was held with a reduced quorum. Voted against the freedom the rapporteur, Edson Fachin, and the minister Dias Toffoli, By understood that the issue of pre-trial detention can not be judged by means of habeas corpus. Gilmar Mendes was the only one to vote for the granting of freedom. Ministers Ricardo Lewandowski and Celso de Mello did not attend the session for health reasons.
Even if the decision were favorable, Cunha still stuck due to two arrest warrants issued by the Federal District and the other by Justice of Rio Grande do Norte in other investigations.
