Supreme Court denies request for Eduardo Cunha to get stuck in Brasilia

Cunha was sentenced to 15 years in prison for passive corruption and money laundering, without right to appeal in freedom.

The president of the Superior Court of Justice (STJ), Minister Laurita Vaz, decided today (19) deny the transfer of former Deputy Eduardo Cunha, arrested in Operation Lava Jet, for the prison system in Brasilia. Cunha was sentenced to 15 years in prison for passive corruption and money laundering, without right to appeal in freedom. currently, he's stuck in Medical Penal Complex (CMP), the metropolitan region of Curitiba.

in the decision, the minister held that the issue should be decided on merit and that the application has already been rejected by the Federal Court in Brasilia and by Judge Sergio Moro, Rapporteur of Lava Jet in Curitiba.

Cunha's lawyers argued that the wife of former parliamentary lives in Brasilia, the office of his defense is in the federal capital and the offsets for testimonials in various investigations generate costs to the government.

However, the decision, Moro said that is not convenient for the criminal proceedings to transfer Cunha to Brasilia or Rio, where the former lawmaker would have political influence.

"His political influence in Curitiba is certainly lower than in Brasilia or in Rio de Janeiro. Keep it away from their former partners prevent criminals or hinder the practice of new crimes and, in this way, contribute to the proper execution of the sentence and progressive rehabilitation of the convict ", decided.
