in the decision, Mendes attended the order of freedom made by the defense of the accused and found that the prison violated his decree previous understanding, in which determined the release of Bob Richa, who was also arrested, but benefited from habeas corpus given by him.
"All these individuals are arrested by the same decision, that is devoid of adequate justification and seeks to violate, by oblique via, the judgment of the Supreme Court in ADPF 444, the absence of very personal reasons to justify the restriction of freedom of these people ", decided Mendes.
In accusation of breach of fundamental precept (ADPF) 444, whose trial ended last June, the ministers declared “incompatibility with the Constitution of coercive conduct of investigation or defendants for questioning, under penalty of disciplinary action, civil and criminal agent or authority and illegality of the evidence obtained, without prejudice to the liability of the State”.
The arrests were carried out in Operation Integration, part of the 55th stage of the jet wash. On Wednesday (26), federal police arrested José Richa and more 14 investigated and fulfilled 73 search warrants to investigate allegations of corruption in Paraná highway toll contracts.
